General Terms and Conditions Kootstra & Co

Article 1 - Definitions

  1. Kootstra & Co: The company that carries out plumbing and electrical work.
  2. Client: The natural or legal person who uses the services of Kootstra & Co.
  3. Agreement: Any agreement between Kootstra & Co and the customer for the delivery of services or goods.
  4. Invoice: The payment request that Kootstra & Co sends to the customer after completion of the work.

Article 2 - Applicability

  1. These general terms and conditions apply to all quotations, agreements and work carried out by Kootstra & Co.
  2. Deviations from these conditions are only valid if agreed in writing.

Article 3 - Quotations and Agreements

  1. Quotations are without obligation and valid for 14 days, unless stated otherwise.
  2. The agreement is concluded after written confirmation by the customer or after commencement of the work.

Article 4 - Execution of the work

  1. Kootstra & Co carries out the work to the best of its ability and in accordance with the applicable standards and regulations.
  2. The customer must ensure a safe and accessible working environment.

Article 5 - Cancellation and Change of Orders

  1. The customer can cancel an order up to 24 hours before commencement without additional costs.
  2. In case of cancellation within 24 hours, Kootstra & Co may charge cancellation costs.
  3. Changes to the order must be communicated in a timely manner and may lead to adjusted costs and planning.

Article 6 - Force Majeure

  1. Kootstra & Co is not liable for delays or damage due to force majeure, such as extreme weather conditions, material shortages or strikes.
  2. In the event of force majeure, Kootstra & Co reserves the right to suspend or cancel the agreement without compensation.

Article 7 - Warranty

  1. Installations placed by Kootstra & Co have a warranty period of 1 year after installation.
  2. The warranty will be void if:
    • There is incorrect use or insufficient maintenance.
    • Modifications or repairs have been carried out by third parties without the permission of Kootstra & Co.
    • Damage is caused by external influences, such as water damage or lightning strike.

Article 8 - Retention of title

  1. Delivered materials and installations remain the property of Kootstra & Co until full payment has been made.
  2. In the event of non-payment, Kootstra & Co has the right to take back the delivered goods.

Article 9 - Additional Work and Extra Costs

  1. If during implementation it appears that additional work is required, this will only be carried out after consultation with the customer.
  2. Additional work will be invoiced separately at the applicable hourly rate and material price.

Article 10 - Payments

  1. Payment must be made within 14 days of the invoice date, unless otherwise agreed.
  2. If the customer does not pay within the payment term:
    • Additional costs will be charged, such as collection costs and statutory interest.
    • Can Kootstra & Co engage a collection agency or bailiff to collect the claim?

Article 11 - Liability

  1. Kootstra & Co is not liable for indirect damage, consequential damage or lost profits.
  2. The liability of Kootstra & Co is limited to the amount of the invoice for the relevant assignment.

Article 12 - Use of Data and Privacy

  1. Kootstra & Co processes personal data in accordance with the applicable privacy legislation (GDPR).
  2. Customer data is only used for billing, communications and business operations and is not shared with third parties without permission.

Article 13 - Working hours and accessibility

  1. Kootstra & Co works during regular working hours from Monday to Friday from 08:00 to 17:00.
  2. Emergencies outside of working hours may incur additional costs and will be invoiced separately.

Article 14 - Complaints and Disputes

  1. Complaints about work must be reported in writing within 14 days of delivery.
  2. Disputes are preferably resolved by mutual agreement. If this is not possible, disputes will be submitted to the competent court in the Netherlands.

Article 15 - Applicable law

  1. All agreements and disputes are subject to Dutch law.

By using the services of Kootstra & Co, the customer agrees to these general terms and conditions.
